Should search warrants only be executed in the daytime?
Sen. Kiko Pangilinan questioned the serving of search warrants on the Parojinogs’ residences before dawn Sunday. “Serving warrants of arrest past 2 a.m., disabling the CCTVs prior to entering the premises, all 15 suspected drug lords at the scene of the crime and their ‘armed to the teeth’ bodyguards are killed, no injuries or casualties on the side of the PNP. Hindi makatotohanan. Puwedeng gawin ito kaninuman,” Pangilinan said.
On the other hand, Philippine National Police chief Ronald “Bato” dela Rosa insisted that there was nothing wrong with serving search warrants during the wee hours of the day.
“Every time is a legal time to serve search warrant. Walang sinabi doon na kailangan i-serve mo ‘yan during office hours,” the PNP chief said. “Ibig sabihin you are commanded to serve the search warrant anytime of the day, any day of the week, 24/7 ‘yan,” he added.
Senator Francis “Chiz” Escudero, however, disagreed with the PNP chief, saying the rules of court and even the PNP’s revised manual were very clear.
“General Bato is mistaken. He is wrong. The rules of the court is clear. The revised PNP manual itself — which he should know – is also clear,” Escudero told in one of his TV invertiews.
